1. Acceptance of Terms

This website, www.tonyachaplincoaching.com (the "Site"), is owned and operated by Tonya Chaplin Coaching LLC ("Company," "we," "us," or "our"). By accessing or using the Site, or by engaging Company for coaching services, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms that apply to specific services or engagements.

Accessing the Site in any manner — automated or otherwise — constitutes your agreement to these Terms.

We may update these Terms at any time. The current version, with its effective date, will always be posted on this page. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

2. Coaching Services & Professional Disclaimer

Company provides professional coaching services. Tonya Chaplin holds a Professional Certified Coach (PCC) credential and adheres to the International Coaching Federation (ICF) Code of Ethics.

Coaching is not therapy, counseling, medical treatment, or the practice of psychology, and is not a substitute for professional medical, mental health, legal, or financial advice. If you are experiencing a medical or mental health crisis, please contact a licensed professional or emergency services.

Coaching outcomes depend on your own effort, circumstances, and participation. Company does not guarantee specific results from coaching engagements.

3. Session Recording

Some coaching sessions or calls may be conducted and recorded via Zoom for note-taking, quality, and reference purposes. By participating in a recorded session, you consent to that recording. If you do not wish to be recorded, please notify Company in advance so alternative arrangements can be made.

4. Intellectual Property Rights

This Site and its content (text, graphics, logos, coaching materials, and other content) are the property of Company and/or its licensors, protected by copyright, trademark, and other intellectual property laws. The Site is provided for your personal, non-commercial use. You may view, download, or print individual pages for your own personal use only, provided all copyright notices remain intact.

You may not modify, copy, reproduce, republish, sell, distribute, or create derivative works from Site content without Company's express written authorization.

The Site does not accept user-generated content (such as public comments, reviews, or uploads), so no license from you to Company is required for that purpose.

5. Disclaimers

The Site does not link to or integrate third-party vendor sites for purchases. Client relationship management, scheduling, and payment processing are handled through Company's CRM platform (HoneyBook), which has its own terms and privacy practices.

The Site and all information, products, and services offered through it are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

6. Limitation of Liability

To the fullest extent permitted by law, Tonya Chaplin Coaching LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or coaching services, even if advised of the possibility of such damages.

Our total liability for any claim arising from these Terms or your use of the Site or services will not exceed the total amount you paid Company in the twelve (12) months preceding the claim.

7. Indemnification

You agree to indemnify and hold harmless Tonya Chaplin Coaching LLC, its affiliates, and their officers, members, agents, and employees from any claims, damages, liabilities, costs, and expenses arising from your breach of these Terms or misuse of the Site.

8. Client Data & Privacy

Company collects and stores client and lead information through HoneyBook (CRM and payment processor). Company does not collect social media account information or health information through the Site. Financial/payment information is collected through a secure payment link within HoneyBook, not directly by Company.

Company does not sell or share your personal information with third parties, other than the service providers (such as HoneyBook and Zoom) used to operate the business.

9. SMS/Text Messaging Program

Company offers an SMS/text messaging program for clients and leads who choose to opt in.

How you opt in: You may opt in to receive text messages from Company by submitting your mobile phone number through a web form on the Site and affirmatively consenting to receive SMS messages at that time.

Types of messages: By opting in, you may receive text messages related to appointment reminders, coaching updates, and promotional or marketing offers from Company.

Message frequency: Message frequency may vary.

Message and data rates may apply.

Opt-out and help: You may unsubscribe from SMS messages at any time by replying STOP to any message you receive from us. Reply HELP for assistance, or contact us directly using the information in Section 14.

Data use: Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. This does not include service providers who help us operate our SMS program (such as our texting/CRM platform) under confidentiality obligations, or disclosures required by law.

10. Registration & Client Portal

The Site itself does not require account registration. Where you engage Company for coaching services, scheduling, document-sharing, and payment are handled through Company's HoneyBook client portal, which has its own login and security practices. You are responsible for keeping your HoneyBook credentials confidential and for all activity under your account there.

11. Termination

We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms or engaged in unlawful or inappropriate conduct. Termination of Site access does not by itself terminate a separate coaching services agreement, which is governed by its own terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

Any dispute arising from these Terms will be resolved exclusively in the state or federal courts located in Georgia, and you consent to personal jurisdiction there.

13. Changes to These Terms

We may update these Terms periodically. The current version and effective date will always be available on this page.
